Automatic suspensions and cross undertakings in damages – is the time right?
Where a claimant is granted an injunction pending examination of a legal dispute, it is common for the court to require the claimant to provide a “cross undertaking in damages”. In a public procurement context, it has not been clear whether the court can impose a requirement for a cross undertaking in damages before it has heard an application to lift an automatic suspension.
