Litigation is the formal process of bringing a claim to a court of law, generally starting with issuing a claim and ending with a trial before a judge or a negotiated settlement. Initiating this process is required when a dispute has arisen and the parties are unable to reach a resolution themselves.

Arbitration is similar to litigation. Arbitration is a formal process whereby a party brings their claim before an arbitral tribunal. The main difference between arbitration and court litigation is that the claim is heard by an arbitral tribunal (often selected by the parties themselves) and is conducted in private (ie it's a confidential process).
