Construction, engineering
and energy disputes

Disputes, and the resolution of those disputes, are a reality for those operating in the construction industry. When disputes arise, we can assist you in resolving them favourably.

Construction projects involve complexity. The works being carried out are often complex and so are the contractual documents governing the parties' relationship, and the applicable legal principles.

The result is that when a dispute does occur, expert legal advice will be required on the myriad of factual, technical and legal issues that arise and the best tactical approach to be adopted in order to resolve the dispute favourably.

Our team of construction disputes lawyers have a wealth of experience in providing the necessary guidance and assisting clients in resolving their disputes through adjudication, arbitration, litigation and alternative dispute resolution.

Our experience

We have decades of experience in acting for a range of clients on construction disputes of varying degrees of complexity. Our team's experience includes:

  • Successfully acting for the contractor in the TCC case of Mears Limited v Costplan Services (South East) Limited & others regards the meaning of practical completion

  • Acting for one of the UK's leading support services and construction companies in a dispute with a well-known retailer regarding the facilities management services provided by our client. The matter proceeded in the Commercial Court and was settled on terms favourable to our client prior to trial.

  • Acting in Macob Civil Engineering v Morrison Construction Ltd, the first case to consider the adjudication provisions found in the Housing Grants Construction and Regeneration Act

  • Successfully defending a £40 million final account claim commenced by a tier 1 contractor against a local authority in adjudication proceedings and in the ad hoc arbitration that followed

  • Successfully acting in a multi-million pound cross-border adjudication for a multinational engineering, procurement and construction client

  • Acting for an infrastructure contractor in serial adjudications with its employer and sub-contractor regards payments due in respect of critical infrastructure works performed in preparation for the Glasgow Commonwealth Games
