Accidental injury can lead to career-ending incapacity, Permanent Total Disability or Temporary Disability, which can be covered under either an Individual or Group A&H insurance policy.  

We have a broad knowledge of the medical conditions and risks associated with problematic claims. This helps us to advise on appropriate investigations to assess causation and the application of any applicable exclusions and bring matters to a resolution. 

Our A&H specialists have over 25 years of advising on product development and best practice in claims handling, with particular experience in sports related risks (whether professional or amateur) and occupations such as the armed forces, close protection & security or those working in high risk areas abroad. This compliments our work in the Political Violence & Political Risk insurance arena.

Helen Tilley has over 20 years’ experience of acting as the Single Point of Contact (SPOC) for the Insurance Investigators Group (IFIG), as part of the firm’s drive to prevent and detect fraud.

Our experience

Examples of work which we have handled include:

  • Advised on coverage and causation in connection with football and rugby players, including sudden cardiac death and myocardial infarction post sustaining a kick on the nose during a match.
  • Represented the Personal Accident (PA) insurers in respect of a £1 million PTD claim by a Formula 1 racing driver based in Monaco who sustained a shoulder injury. Obtained medical evidence from Professor Wallace and an Italian sports specialist on his career leading up to the injury in order to negotiate a favourable resolution.
  • Advising contingency reinsurers on aggregation and coverage issues in relation to worldwide COVID-19 event cancellations. 
  • Advised PA insurer regarding a PTD claim by a security manager injured during a terrorist bomb blast in Mali that involved cardiac symptoms, PTSD and loss of hearing.
  • Advised insurer in respect of a sensitive Group PA claim involving a City solicitor who challenged the assertion that she had “courted a risk” by stepping in front of a tube train in an attempt to self-harm or die by suicide. After considering mobile phone records and CCTV footage secured by the policy, reached a resolution of the Permanent Disability claim through meetings with the solicitor’s supervising partners and their appointed KC.
  • Advise on coverage and causation issues in the context of claims that may involve clinical negligence eg, fatalities shortly after endoscopic surgery and disability following cauda equina syndrome.
  • Provide coverage advice and a monitoring service of overseas lawyers in respect of travel insurance claims (including overseas legal expenses and personal liability claims). These have included education related trips and claims by teachers and students.
  • Consider travel insurance coverage issues arising from increased security risk and emergency evacuation and fitness to fly, including media personnel.
  • Advised on coverage and monitoring of overseas lawyers in connection with a career ending injury of a Formula 1 engineer, at an airport, during a business trip.
  • Advised insurers following a stage collapse that killed two entertainment group employees ahead of a global pop-star’s show in France.
  • Provided coverage advice to insurers on loss of revenue/ticket reimbursement after the member of an indie band suffered an injury whilst motorcycling.
