Construction risks

Our extensive knowledge of both the insurance and construction markets positions us to provide expert insight and commercial advice, quickly and cost effectively.

Our national team of professional indemnity construction lawyers is supported by our dedicated construction and engineering team, which is recognised as one of the UK’s leading practices.

One of our key cases is the successful appeal to the Supreme Court in Aspect Contracts (Asbestos) Limited v Higgins Construction Plc. [2015] UKSC 38.

We deal with all types of construction related disputes, including adjudication, expert determination, litigation and arbitration. The team defend widely varying claims arising from the construction and development of residential homes, to major public infrastructure projects. We're regularly instructed to advise and represent insurers on policy coverage.

Our experience

  • Defending proceedings, claims and notifications relating to Grenfell Tower. This work involved nearly 50 residential tower blocks, student accommodation blocks and hotels. We were instructed on these £multi-million claims by 10 different insurers.

  • Defending a claim for in excess of £40million against geotechnical engineers. This claim arose from a ground investigation report prepared for the construction of a large mixed use residential, business, leisure, and retail development in South London.

  • Advising insurers on cover under a project specific PI Policy relating to a very high profile demolition collapse.

  • Considering an M&E engineers PI policy regarding claims relating to projects to build two anaerobic digestion plants, where the insured is in administration.

  • Defending a claim involving inadequately designed secure louvres on a nuclear sub-station. This involved complex issues regarding security and expert corrosion advice.

  • Advising a rapidly growing design and build contractor about its strategy for defence and recovery of losses from its consultants. Following a multi-million pound refurbishment of a hotel complex, serious deficiencies were discovered in the design of a swimming pool with adverse impact on the wider fabric of the building.
