Payment Notices and Pay Less Notices – calculating time Christmas 2018

When calculating time in England and Wales under the Housing Grants Construction and Regeneration Act (as amended) (“the Act”) this Christmas, be aware that in relation to Payment Notices (including Default Payment Notices) and Pay Less Notices the following days do not count:

  • Christmas Day
  • Boxing Day
  • New Year’s Day

Remember

  • Weekends do count unless they are excluded for another reason – for instance when Christmas Day falls on a Sunday.
  • The days that count vary from year to year

These rules also apply to adjudication proceedings (and to withholding notices if you have a construction contract entered into before October 2011).
