The Box: What are the chances? Causation in claims against insurance brokers

In our April edition of The Box, James Thompson and Shaira Begum consider the Court of Appeal’s approach to causation in Norman Hay Plc v Marsh Ltd in claims against insurance brokers.

They'll discuss how the courts will approach cases where a broker has failed to put cover in place and the court is asked to assess the likelihood that hypothetical cover would have been available if the broker had done its job.

James and Shaira will also discuss the importance of expert underwriting evidence in this type of case and the potential impact on the assessment of damages.
