Student accommodation and the Building Safety Levy
The Government has announced the implementation of the Building Safety Levy, now scheduled to come into effect in Autumn 2026, a year later than previously anticipated. This levy will apply to all new dwellings and purpose-built student accommodation requiring a building control application.
Exemptions
The following categories will be exempt from the levy:
- Affordable housing
- Non-social homes built by not-for-profit registered providers
- NHS hospitals
- Care homes
- Supported housing
- Children’s homes
- Domestic abuse shelters
- Accommodation for armed services personnel
- Criminal justice accommodation
- Developments of fewer than 10 units
Levy calculation
The levy amount will be determined based on the floorspace, measured using the gross internal area (including communal areas) as per the RICS Code of Measuring Practice 6th Edition Rates. The rate per square metre will vary by local authority area, with specific rates available here.
Discounts
Developments on previously developed land will receive a 50% discount.
Compliance
Non-payment of the levy will result in the withholding of the building control completion certificate, which is crucial for higher-risk buildings that cannot be occupied until registered. Registration requires a completion certificate.
Review cycle
The Government intends the levy will be reviewed every three years.
